Ohio law provides that, where an individual’s death has been caused by the wrongful act or neglect of another, the surviving spouse, children, parents, and next of kin of the deceased may bring an action against the wrongdoer.
Recovery includes the loss of support, services, and society of the deceased, and the mental anguish suffered by the surviving spouse, children, parents, and next of kin. The wrongful death action is administrated through the probate court and, therefore, involves more procedures than a typical personal injury action.
